1. Introduction & Definitions

Welcome to Amalah (accessible at amalah.app), a Software-as-a-Service ("SaaS") platform operated in the State of Kuwait. Amalah provides digital tools for licensed domestic worker recruitment offices ("Offices") to manage worker profiles, reservations, and daily operations.

Amalah is strictly a technology platform. It is NOT a recruitment office, employment agency, or labor broker. Amalah does not recruit, employ, sponsor, or place domestic workers. It does not participate in hiring decisions, employment contracts, or any business relationship between Offices, Workers, and Clients.

In these Terms:

  1. "Platform" means the Amalah web application and related services.
  2. "Office" or "You" means the recruitment office entity or its authorized representative registered on the Platform.
  3. "Employee" means any user granted access by an Office to operate through the Platform.
  4. "Worker" means any domestic worker whose profile data is entered into the Platform by an Office.
  5. "Client" means a household or individual seeking domestic worker services through an Office.
  6. "We", "Us", or "Our" refers to Amalah and its operators.

2. Acceptance of Terms

By registering for, accessing, or using Amalah, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must stop using the Platform immediately. These Terms form a binding electronic agreement in accordance with applicable laws in the State of Kuwait.

3. Eligibility & Registration

To register on Amalah, you must:

  1. Be a legally established domestic worker recruitment office in the State of Kuwait.
  2. Hold a valid license issued by the relevant Kuwaiti authorities.
  3. Provide accurate and up-to-date registration information (office name, license number, phone, email).
  4. Ensure the person registering is authorized to bind the Office to these Terms.

We may verify your license status at any time and suspend or terminate access if your license is expired, revoked, or invalid.

4. Account Security

You are responsible for keeping your account credentials confidential. Notify us immediately if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account due to your failure to protect your credentials.

Unauthorized access to information systems is a criminal offense under applicable Kuwaiti law. You agree not to access accounts, data, or systems that do not belong to you.

5. Permitted Use

Amalah may only be used for:

  1. Managing domestic worker profiles, photos, and documents for legitimate recruitment operations.
  2. Tracking reservations and placements between Offices and Clients.
  3. Managing Office employees and their access permissions.
  4. Generating public office pages to display available workers to potential Clients.
  5. Exporting business data (CSV) for internal record-keeping.

6. Prohibited Conduct

You agree NOT to:

  1. Use the Platform for any illegal activity, including human trafficking, forced labor, fraud, or any violation of applicable laws.
  2. Charge workers any fees through the Platform. Recruitment fees must not be borne by workers, as required by applicable Kuwaiti law.
  3. Upload content that is defamatory, obscene, harassing, or discriminatory, or that violates any person's rights or dignity.
  4. Classify or tag workers by religion, race, sect, or any other sensitive attribute. Worker profiles must be limited to professional and recruitment-relevant information only.
  5. Misrepresent worker identities, qualifications, health status, or any material information.
  6. Share, sell, or transfer your account credentials to unauthorized third parties.
  7. Attempt to hack, reverse-engineer, or interfere with the Platform's systems or security.
  8. Use bots, scrapers, or automated tools to access the Platform without written consent.
  9. Use the Platform to create competing services, replicate the Platform, or build external systems that rely on the Platform's data, structure, or functionality without prior written permission.

Violations may result in immediate account suspension or termination, and may be reported to the relevant authorities.

7. Office Responsibility & Worker Data

As a technology platform, Amalah does not verify or control the data entered by Offices. Each Office is fully and solely responsible for:

  1. Obtaining valid consent or lawful basis before collecting, uploading, and displaying any worker personal data.
  2. Ensuring all worker data is accurate, truthful, and up-to-date. Misrepresentation is a violation of these Terms and applicable law.
  3. Using worker photos and documents solely for legitimate recruitment purposes.
  4. Complying with all applicable data protection and labor laws in Kuwait and the worker's home country.
  5. Promptly updating or archiving records when a worker is no longer associated with the Office.

8. Public Display of Worker Data

Public office pages display only limited, non-sensitive worker information: nationality, age, skills, and a profile image. No full names, passport numbers, ID numbers, dates of birth, or other identity documents are displayed publicly.

Offices control which workers appear publicly by managing their availability status. Amalah is not responsible for the accuracy of data displayed by the Office within the limits of the Platform.

9. Intellectual Property

All intellectual property in the Platform (design, code, logos, trademarks) is owned by Amalah. You may not copy, modify, or create derivative works from any part of the Platform without written consent.

  1. You retain ownership of all data you upload (worker profiles, documents, logos).
  2. By uploading content, you grant Amalah a limited license to store, process, and display it solely for providing the service.

10. Subscription & Payments

Access to Amalah may require an active subscription. Pricing and billing terms will be communicated clearly at purchase. All transactions shall comply with applicable laws in the State of Kuwait.

Subscription fees are non-refundable unless required by law. We may modify pricing with 30 days' notice. Failure to maintain a subscription may restrict access to certain features. Amounts are in Kuwaiti Dinars (KWD) unless stated otherwise.

11. No Guarantee of Results

Amalah is a management tool. We do NOT guarantee any business outcomes, including but not limited to: number of clients, bookings, reservations, placements, or revenue. Your results depend entirely on your own operations, marketing, and service quality.

The Platform may be affected by maintenance, updates, or technical issues. Amalah does not guarantee uninterrupted or error-free availability of the service. We do not guarantee the accuracy of any data entered by Offices.

Amalah has no responsibility for recruitment practices, employment conditions, or relationships between Offices, Workers, and Clients. Offices are solely responsible for compliance with all applicable laws.

12. Limitation of Liability

To the maximum extent permitted by law, Amalah shall not be liable for:

  1. Any indirect, incidental, special, or consequential damages.
  2. Loss of profits, data, business opportunities, or goodwill.
  3. Damages arising from unauthorized access to your data.
  4. Damages arising from the actions or omissions of Offices, Workers, or Clients.
  5. Any matter beyond our reasonable control.

Our total liability for any claim shall not exceed the fees you paid to Amalah in the twelve (12) months before the claim.

13. Indemnification

You agree to indemnify and hold harmless Amalah from any claims, damages, or expenses arising from:

  1. Your use of the Platform or violation of these Terms.
  2. Your violation of any law or third-party rights.
  3. Any claim related to your recruitment practices or worker/client relationships.
  4. Data entered by you or your Employees into the Platform.

14. Data Retention

We retain data as necessary for service provision and legal compliance. Upon account termination, data may be archived as required by applicable law. You may request data export before termination.

15. Suspension & Termination

We may suspend or terminate your access if you violate these Terms, if your license is expired or revoked, if required by law, if your use poses risk to others, or for non-payment after a 15-day grace period. You may terminate at any time by contacting us. Termination does not relieve prior obligations.

Amalah reserves the right to modify, suspend, or discontinue any part of the service at any time for operational, technical, or legal reasons.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Kuwait. Disputes shall be subject to the jurisdiction of the competent courts in Kuwait City.

Both parties agree to attempt good-faith negotiation for at least 30 days before formal proceedings.

17. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or in-platform notification at least 15 days in advance. Continued use after changes take effect means you accept the updated Terms.

18. General Provisions

If any provision is found invalid, the remaining provisions continue in full effect.

These Terms and the Privacy Policy form the entire agreement between you and Amalah.

Our failure to enforce any provision does not waive that right.

These Terms are in English and Arabic. In case of conflict, the Arabic version prevails.
